This Disclaimer governs your access to and use of the zygig website and any information, content, tools, or services made available through it (collectively, the "Site"). By using the Site, you acknowledge and agree to the terms of this Disclaimer. If you do not agree, please do not use the Site.
1. Informational Purposes Only
All content on the Site is provided for general informational purposes only. It does not constitute professional, legal, financial, medical, or other specialist advice, and should not be relied upon as the basis for any decision or action. You should seek advice from a qualified professional before acting on any information presented on the Site.
2. No Warranties
The Site and all content, materials, and services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, zygig disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any information or output will be accurate, complete, reliable, current, or suitable for your needs.
3. AI Outputs
Our services may involve artificial intelligence systems that generate predictions, recommendations, content, or other outputs. AI outputs can be inaccurate, incomplete, or unsuitable for a particular purpose. You are solely responsible for reviewing, validating, and deciding whether and how to use any AI-generated output. zygig makes no warranty that any AI output will be fit for your intended use.
4. Limitation of Liability
To the fullest extent permitted by applicable law, zygig, its affiliates, officers, directors, employees, contractors, agents, and licensors shall not be liable for any damages of any kind arising out of or related to your access to, use of, or inability to use the Site or any services, content, or AI outputs, including but not limited to direct, indirect, incidental, consequential, special, exemplary, punitive, or any other damages, losses, costs, or expenses. This includes, without limitation, damages for loss of profits, revenue, business, goodwill, data, use, opportunity, or other intangible losses, even if we have been advised of the possibility of such damages and regardless of the legal theory on which the claim is based (contract, tort, negligence, strict liability, statute, or otherwise).
Without limiting the foregoing, zygig is not liable for any decisions made, actions taken, or results obtained based on information, content, or outputs from the Site or our services. You assume all risk associated with your use of the Site.
5. Cap on Liability
To the maximum extent permitted by law, the total aggregate liability of zygig and its affiliates for any and all claims arising out of or related to the Site shall not exceed one hundred U.S. dollars (US$100). Where our services are provided under a separate written agreement, the liability provisions of that agreement shall govern.
6. Third-Party Content and Links
The Site may include content provided by third parties or links to third-party websites and resources. We do not endorse and are not responsible for the accuracy, legality, or availability of any third-party content. Your use of any third-party content or website is at your own risk.
7. Indemnification
You agree to defend, indemnify, and hold harmless zygig and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Site or your violation of this Disclaimer.
8. Jurisdictional Limitations
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
9. ClearCheck (mobile app)
This section applies to ClearCheck, zygig's mobile app for iOS and Android (see the ClearCheck product page), in addition to the sections above.
ClearCheck is not medical or regulatory clearance. It does not determine, certify, or guarantee that you are fit for duty. If you are sick enough to need medication, the underlying condition — not just the medication — may be what keeps you off duty, independent of any wait time ClearCheck computes or any classification it shows. Pilots: ClearCheck's output is independent of, and does not substitute for, your obligations under 14 CFR 61.53; always consult your Aviation Medical Examiner. Flight attendants, commercial drivers, and train conductors should consult whoever their role's applicable guidance points to — a medical examiner, your employer's safety/compliance office, or your company's own policy — before relying on ClearCheck's output.
Only the Pilot role's wait time is FAA-derived. ClearCheck computes a numeric wait time using a published FAA rule of thumb for the Pilot role only. FMCSA and FRA, which govern commercial drivers and train conductors respectively, do not publish an equivalent numeric formula; for those roles ClearCheck shows an ingredient classification and a citation to the governing regulation, with no fabricated wait time. The Flight Attendant role's classifications are marked unverified pending further citation research and should be treated accordingly.
UNKNOWN is not a clean bill. A large share of the underlying medication database (sourced from the FDA's openFDA catalogue) has not been individually assessed against the applicable safety guidance. ClearCheck shows this honestly as UNKNOWN, meaning no wait has been computed and none has been ruled out — it is a gap in the available data, not a finding that no wait is needed.
Medication data accuracy. ClearCheck's medication database, whether bundled with the app or fetched from zygig's sync service, is compiled from third-party sources including the FDA's openFDA catalogue and may contain errors, omissions, or out-of-date information. Barcode matching relies on manufacturer-published product codes, which may not exist for every product or may not match a given package. Always cross-check against the medication's own label and consult a qualified professional if you have any doubt.
The general disclaimers, limitation of liability, and cap on liability in the sections above apply in full to ClearCheck and its output.
10. Changes to This Disclaimer
We may update this Disclaimer from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site or ClearCheck after any such changes constitutes your acceptance of the revised Disclaimer.
